About these terms

These Terms & Conditions (“Terms”) form an agreement between you and OptivaTemplates (“OptivaTemplates”, “we”, “us” or “our”). They apply to your use of optivatemplates.com (the “Site”) and to every theme, template and related file you buy or download from us (the “Products”).

By browsing the Site, creating an account or completing a purchase, you agree to these Terms, our Privacy Policy, our License Terms and our Refund Policy. If you do not agree, please do not use the Site or buy our Products.

Eligibility and accounts

You must be at least 18 years old, or the age of legal majority where you live, to buy Products. If you buy on behalf of a company or client, you confirm that you have the authority to accept these Terms for them.

When you create an account, you agree to give accurate information and keep it up to date. You are responsible for keeping your login details private and for all activity that takes place under your account. Tell us straight away if you believe someone has accessed your account without permission.

Our products

OptivaTemplates designs and sells digital website themes and templates for WordPress, Astro, Framer, Shopify and Webflow. Each product page describes the features, included pages, platform requirements and license type for that Product.

Live demos show how a Product can look once it is set up. Demo text, images and sample data are there for illustration. Depending on the Product and the licenses that apply to them, some demo images may not be included in the download, or may be replaced with neutral placeholders.

We work hard to describe every Product accurately, but we do not guarantee that a Product will meet every requirement of your project. Please review the live demo and product page before buying, and email us if you have any questions.

Prices and payment

All prices are shown in US dollars unless stated otherwise. The price you pay is the price shown at checkout when you complete your order. Any sales tax, VAT or similar charge required in your country is added at checkout where applicable.

Payments are handled by secure third-party payment processors. We do not see or store your full card number. By submitting payment details, you confirm that you are authorized to use the payment method.

We may change prices, run promotions or update product bundles at any time. Price changes never affect orders that have already been completed.

Delivery

All Products are digital and are delivered instantly once your payment is successfully processed. You will receive access to your download from your account and in your order confirmation email. Framer and Webflow templates may be delivered as a remix or duplicate link instead of a file.

If you do not receive your download or confirmation email within a few minutes of payment, please check your spam folder, then email support@optivatemplates.com with your order details and we will help you right away.

Licensing

Buying a Product gives you a license to use it. It does not transfer ownership of the Product to you. Every Product is sold with a single license, which means it can be activated on one domain only, unless the product page states that it is a bundle license covering more domains. The full rules are set out in our License Terms.

Refunds

Because our Products are digital and delivered instantly, all sales are final and we do not offer refunds. Please read our Refund Policy for details and for how we help when something goes wrong.

Support

Theme support is provided by email only, at support@optivatemplates.com. Please include your order number, the Product name, the domain where it is installed and a clear description of the issue, with screenshots if possible. We aim to reply within two business days.

Support covers installing the Product, importing demo content, using the included settings and fixing bugs in our code. It does not cover custom design or development work, problems caused by third-party plugins, apps or hosting, or changes you have made to the Product’s code. If you need custom work, we are happy to provide a separate quote.

Updates

We release updates to fix bugs, improve performance and keep Products compatible with new versions of their platforms. Updates are made available through your account for as long as a Product is actively maintained. We recommend backing up your website before installing any update.

Third-party platforms, plugins and services

WordPress, Astro, Framer, Shopify and Webflow are trademarks of their respective owners. OptivaTemplates is an independent company and is not affiliated with, endorsed by or sponsored by any of them.

Your use of these platforms, and of any third-party plugin, app, font or service used with our Products, is subject to that provider’s own terms. We are not responsible for changes those providers make to their platforms, pricing or availability.

Images and demo content

Images shown on the Site and in our live demos come from free stock photo libraries, namely Pexels, Pixabay, StockSnap and PxHere. These images belong to their original creators and are used under the license terms of each library. They are not owned by OptivaTemplates and are not sold as part of any Product. See our License Terms for how this affects your use of them.

Acceptable use of the Site

When using the Site, you agree not to:

• break any law or encourage anyone else to do so;
• try to gain unauthorized access to the Site, other accounts or our systems;
• upload or send viruses, malicious code or spam;
• scrape, copy or mirror the Site or our Products by automated means;
• share, resell or publish download links, license keys or account access.

We may suspend or close accounts that break these rules.

Intellectual property

All content on the Site that we created, including our designs, code, text, graphics and logo, belongs to OptivaTemplates and is protected by copyright and other intellectual property laws. Apart from the rights granted to you in our License Terms, nothing in these Terms gives you any right to use our brand or content.

Disclaimer

Products are provided “as is” and “as available”. To the fullest extent allowed by law, we make no warranties beyond those set out in these Terms, including implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not guarantee that a Product will be error-free, will work with every plugin, app or hosting setup, or will produce particular business results.

Limitation of liability

To the fullest extent allowed by law, OptivaTemplates will not be liable for any indirect, incidental, special or consequential loss, including loss of profits, revenue, data or business opportunities, arising from your use of the Site or Products. Our total liability for any claim relating to a Product is limited to the amount you paid for that Product.

Nothing in these Terms limits liability that cannot be limited by law, or removes any rights you have as a consumer under the law of your country.

Indemnity

You agree to compensate OptivaTemplates for any claims, losses or costs, including reasonable legal fees, that arise from your breach of these Terms or the License Terms, or from content you publish on a website built with our Products.

Suspension and termination

We may suspend or end your access to the Site, your account or your license if you seriously or repeatedly break these Terms or the License Terms. If your license ends, you must stop using the Product and delete all copies of it.

Resolving disputes

If you have a complaint, please email support@optivatemplates.com first. Most issues can be resolved quickly this way, and we will make a genuine effort to settle any dispute informally within 30 days. If a dispute cannot be resolved informally, it will be handled under the laws and by the courts that apply under your local consumer protection rules, or otherwise under the laws that apply to OptivaTemplates.

Changes to these terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page. The version in effect at the time of your purchase applies to that purchase. Continuing to use the Site after an update means you accept the revised Terms.
